General Terms

Intellectual property

PulseHarbor retains all rights to the software, documentation, and brand assets you access through vestha.digital. You receive a limited, non-exclusive license to use the platform for your internal business operations during an active subscription.

You may not reverse engineer, resell, or sublicense the platform without written approval. Customer data you upload remains yours, and you grant PulseHarbor permission to process it solely to deliver the services you configure.

Acceptance of terms

By creating an account, requesting a demo, or using any workspace provided by PulseHarbor, you confirm that you have authority to bind your organization and that you accept these General Terms.

If you do not agree, discontinue use immediately. Continued access after updates constitutes acceptance of the revised terms posted with a new last updated date.

Service description

PulseHarbor provides a customer data workspace for direct-to-consumer brands, including identity stitching, audience building, activation connectors, and lifecycle reporting. Features available to you depend on the platform plan you select.

We may introduce improvements, maintenance windows, or connector updates. We will provide reasonable notice for material changes that affect your production workflows, except for urgent security updates.

Governing law and venue

These terms are governed by the laws of the Republic of Korea. Courts in Seoul have exclusive jurisdiction, without prejudice to mandatory consumer protections that may apply where you are located.

If a provision is unenforceable, the remaining provisions stay in effect to the fullest extent permitted.

Customer responsibilities

You are responsible for lawful collection of shopper data, honoring marketing preferences, and configuring access roles inside your workspace. You must not upload unlawful content or attempt to probe our infrastructure beyond permitted API usage.

You agree to maintain accurate billing contacts and notify us of security incidents that may impact PulseHarbor systems within forty-eight hours of discovery.

Liability limits

To the extent permitted by Korean law, PulseHarbor is not liable for indirect losses, lost profits, or consequential damages arising from use of the platform. Aggregate liability for any claim relating to a twelve-month period is capped at the fees you paid for the platform during that period.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by applicable law.

Suspension and termination

Either party may terminate for material breach if the breach is not cured within thirty days of written notice. We may suspend access immediately if we detect activity that endangers platform integrity or violates law.

Upon termination, we will provide a reasonable window to export your data according to the data retention section of the Privacy Statement. Fees owed through the termination date remain payable.

Exceptions

Custom implementation hours that have already been delivered, third-party pass-through fees, and domain-specific onboarding workshops are not eligible for reversal once work has started.

If a plan includes prepaid annual usage, partial credits may apply as described in the timeframe section.

Timeframe

New subscriptions may request a full reversal within fourteen days of the initial invoice date provided fewer than twenty thousand tracked profiles have been processed and no enterprise connector beyond the sandbox tier was activated.

After fourteen days, fees are non-refundable except where required by mandatory consumer law in Korea.

Scope

This policy covers platform fees billed directly by PulseHarbor through vestha.digital. Invoices handled entirely by a reseller partner are governed by that partner’s policy.

Send cancellation requests to [email protected] with your workspace ID, invoice number, and reason so we can confirm eligibility.

Process

We acknowledge requests within three business days. Approved reversals are initiated to the original method within ten business days after internal review.

You are responsible for exporting data before access ends; we provide a short read-only window when feasible.

Eligibility

Eligibility depends on plan tier, usage thresholds, and whether professional services were consumed. Our team will share a written decision with citations to the relevant clause.
